1. Definition of Used Terms

The activity carried out within the online platform www.buygames.net is governed by the Terms and Conditions described in this document, terms that define both the concepts and policies that express the contractual relationships established between the administrator of the site and its users during the exploitation of the various functionalities offered by the platform. Thus, in the chapters of the Terms and Conditions, we will use the following definitions and meanings, as below:

- "Site" - means the online platform www.buygames.net,

- The "Administrator" of the platform, also referred to as "We," "Provider," "Company," represents the commercial entity that manages, maintains, and operates the online platform www.buygames.net either on its own behalf, through employees, or through representatives or authorized persons, as the case may be;

- "Manufacturers" - represent third-party companies with which the Company collaborates

- "Users" - represent the visitors of the site, both in the browsing stage and the users who decide to create an account for free on the platform to benefit from additional facilities and functionalities for purchasing the products marketed by the platform;

- "Clients" - are the users who acquire this status after purchasing the products marketed on the Site. Users who become Clients additionally acquire a certain set of rights and guarantees from the platform, as described below:

 

⦁ 2. Commercial Conditions

The prices of the products are updated daily and include VAT. The prices in orders are valid for 48 hours from their confirmation. The availability of product stock is updated at least every 30 minutes, on business days, and may change at any time during order processing.

Products can be reserved from buygames.net stock for a maximum of 48 hours. After this interval, reservations will be automatically deleted.

Discounts, reductions, and promotions cannot be combined. The discount with the highest value always applies.

Products sold through www.buygames.net will be accompanied by an invoice.

The product images are for informational purposes only.

⦁ 4. Cookie Policy

The site administrator buygames.net may use cookie technologies to improve the browsing experience of users, to persistently save, within the logged-in users' sessions, the products and quantities added to the shopping cart, or to personalize the viewing experience of the site. These are encrypted and saved in your browser, do not collect personal data, and are intended to restore the browsing experience on the site when you log in again.

You have the option to block our use of cookies in the browser you use, but this will affect your ability to log in, purchase products, as navigating from one page to another will not retain the added product or logged-in user in that session.

 

⦁ 5. Dispute Resolution

Any misunderstanding arising from the use of the site by clients will be resolved amicably by the parties, in this regard, the client can first contact the provider's customer service at the email address or phone number mentioned on the site's contact page. In cases where this is not possible, the parties may resort to competent judicial authorities in Romania, in all cases the applicable law being Romanian law. Also, in accordance with existing legislation, clients can also use the ODR platform (online dispute resolution platform) located at this address.

Users also have the right to address the National Authority for Consumer Protection, which they can contact at this address.

 

⦁ 6. Warranties Provided

All products sold by the online store www.buygames.net, except those delivered digitally, benefit from warranty conditions in accordance with the current legislation and the commercial conditions of the manufacturers and distributors, all products being new and delivered in original packaging.

 

Products delivered digitally do not benefit from this warranty, as their valorization is considered to be made at the time of transmission/receipt via email of the activation code of the respective product license.

 

In accordance with the provisions of Government Ordinance 34/2014 regarding consumer rights, which regulate the possibility for the client to return the products within 14 calendar days, we have extended the period to 14 calendar days, without any justification. The products delivered in packaging can be returned, and the payment will be fully refunded to the client. Unsealed products and products with digital delivery cannot be returned.

buygames.net reserves the right to refuse the return acceptance after repeated returns (more than two repeated returns for the same product).

⦁ 7. Limitation of Supplier's Liability

The Supplier does not assume responsibility for cases due to the negligence of users in managing their data (e.g., in the event of password alienation, user account, provision of incorrect or incomplete information) or in the event of using the products/services for a purpose other than that for which they were designed, such as attempting to activate codes on platforms other than those for which they were purchased.

 

At the same time, we do not assume any responsibility for situations in which the user publishes their address or any other personal data, on their own initiative, through public messages, on various websites on the internet.

 

Also, we do not respond to damages caused to users by attacks against them through the internet aimed at theft or vandalism of data, which could lead to disclosure or compromise of their login data to their accounts on the site, email accounts, or even their computers, and which could ultimately result in the restriction of access or use of the products.

⦁ 8. Users' Obligations

By this, the user agrees to comply with the following obligations including but not limited to:

- Transmitting correct and complete identification data in case of creating an account for purchasing products from the site,

- Using valid, personal means of payment, not allowing the use of means of payment belonging to other persons (debit or credit bank cards) without their prior consent, the provider reserving the right to cancel any transactions in case of suspicions of fraud in using means of payment.

- Buyer - can be any individual over 16 years of age acting on their own behalf or on behalf of a legal person or entity, who creates an Account on the Site and places an Order, having financial responsibility for all transactions made in their account or name.

 

⦁ 9. Online Sales Policy

Access for placing an Order is permitted to any User/Buyer.

 

For justified reasons, buygames.net reserves the right to restrict the access of the User/Buyer to placing an Order and/or to some of the accepted payment methods if it considers that based on the conduct or activity of the User/Buyer on the Site, their actions could prejudice buygames.net in any way. In any of these cases, the User/Buyer can contact the Customer Relations Department of buygames.net to be informed about the reasons that led to the application of the aforementioned measures.

 

Communication with the Seller can be done through direct interaction with them or through the addresses mentioned in the "contact" section of the Site. The Seller has the freedom to manage the information received without being required to provide justification for this.

 

In the event of an unusually high volume of traffic from an internet network, buygames.net reserves the right to request Users/Buyers to manually enter captcha validation codes in order to protect the information on the Site.

 

buygames.net may publish information on the Site about Goods and/or Services and/or promotions practiced by them or by any other third party with whom buygames.net has partnership agreements, within a certain period of time and subject to available stock.

 

All rates related to Goods and/or Services presented on the Site are expressed in Romanian Lei (RON) and include VAT.

 

The Seller cannot be held responsible for any additional costs incurred by the Buyer, including but not limited to currency conversion fees applied by the issuing bank of their card, if the currency of issue differs from RON. The responsibility for this action lies solely with the Buyer.

We reserve the right to select our customers and to establish online payment as the sole method of payment for customers who place orders and have refused deliveries on www.buygames.net in their activity history.

When, for various reasons, you refuse/return an order, we reserve the right to refuse to honor future orders placed for the same delivery address.

Products purchased through the buygames.net website benefit from the standard warranty of each individual product. Our company does NOT guarantee the availability of products displayed in stock, which is why the company has the right not to partially or fully deliver a certain order if certain products no longer appear in the current offer of the supplier or are not available for other reasons (temporary stock shortage, edition depletion, etc.). In case prices or other product details have been displayed incorrectly, including due to incorrect entry into the database, our company reserves the right to cancel the delivery of the respective product and to notify the customer as soon as possible about the error, if the delivery has not yet been made.

For cash on delivery payment option via courier, a processing fee of 3 Lei applies.

 

 

Retention from the value of returned goods

In accordance with Directive 2011/83/EU, para. 47, to determine the nature, characteristics, and functioning of the goods, the consumer should handle and inspect them in the same way they would be allowed to do in a store. If, as a result of the verification of the conformity, properties, and functionality of the products, it is found that this devaluation was caused by improper handling by you, you will be responsible for any eventual decrease in the value of the products, in proportion to 5% - 50% of the initial value of the purchased good.

The returned product must be in the same condition as at the time of purchase: it must have all accessories, user manual, and warranty certificate. The product must be returned in the original packaging.

 

Additional packaging

The cost of this service is 2 Lei and represents packaging the games in an anti-shock box to avoid their damage during delivery.

 

Terms and Conditions for Ordering Exclusive Products

 

These products represent limited, special selections that we have carefully chosen to make available only to our premium users. They stand out for their quality, rarity, or unique characteristics and are available in limited quantities.

Due to their limited nature and our desire to offer all premium members a fair chance to benefit from these special products, we have established the following rules:

 

• 1. Order limit: Each premium user can order a maximum of 3 exclusive products in a single transaction. This is aimed at ensuring equal access to limited products for all our premium members.
• 2. Multiple orders: Users are asked not to place multiple consecutive orders in an attempt to exceed the limit of 3 products. Violation of this rule may result in the cancellation of orders and/or suspension of premium membership status.
• 3. Availability: Exclusive products are offered subject to availability and may be limited in stock. We reserve the right to refuse or cancel orders that exceed available quantities.
• 4. Return policy: Products purchased from the exclusive section are subject to our standard return policy, available in another section of our website.
